Bluball places particular importance on the protection of each user’s privacy (hereinafter the “User”) and is committed to ensuring such protection in accordance with applicable laws. This policy governs access to and use of the Bluball platform, including the website as well as any application or interface accessible on a mobile device, such as a smartphone or tablet (collectively, the “Platform”), and any associated user accounts.


By using the Platform, the User acknowledges having read this policy and agrees to be bound by it. Bluball reserves the right to modify this policy at any time, at its sole discretion and without prior notice. Any modifications shall take effect upon their publication on the Platform. Personal information
1.1 Collection

Bluball does not collect any personal information without the User’s knowledge. Access to and use of the Platform may occur in accordance with the Terms of Use without the collection of personal information, except where such collection is necessary for the provision of certain services.

No personal information is collected without the User’s prior consent, in accordance with applicable personal data protection laws.

The personal information that may be collected by Bluball is limited to that which is voluntarily provided by the User, including, but not limited to, when:

  • creating a user account;
  • communicating with Bluball (by email or otherwise);
  • using certain features of the Platform. 

To provide the requested services, including the creation and management of a user account, Bluball may require the User to provide certain personal information and, where applicable, supporting documentation.

1.2 Use

Bluball uses personal information solely for the purposes for which it was collected, except where otherwise permitted or required by law. In all other cases, Bluball undertakes to obtain the User’s prior consent before using such information for any other purpose.

Access to personal information is strictly limited to Bluball employees, agents, and service providers who require such information for the performance of their duties, and is subject to applicable confidentiality obligations.

Personal information provided by the User may be used for the following purposes, including:

  • verifying the User’s identity, including age and place of residence, as well as eligibility for the services offered;
  • providing, operating, and improving the services requested by the User;
  • creating, administering, and managing any user account, including processing related operations and transactions;
  • ensuring compliance with the Terms of Use and preventing any unauthorized or fraudulent use of the Platform;
1.3 DISCLOSURE

Bluball may disclose certain personal information to third-party service providers, including providers located outside Canada, where such disclosure is necessary for the provision of its services.

In such cases, Bluball ensures that these providers offer adequate safeguards for the protection of personal information and that the disclosed information is handled in compliance with applicable laws. Bluball remains responsible for the protection and confidentiality of personal information so disclosed.

In the event of a privacy incident involving a serious risk, Bluball will notify the appropriate authorities and affected individuals in accordance with applicable laws.

Bluball implements appropriate administrative, technical, and physical safeguards to protect personal information against loss, theft, unauthorized access, disclosure, modification, or destruction.

Personal information is retained only for as long as necessary to fulfill the purposes for which it was collected, subject to applicable legal obligations. 1.5 Right of Access and Rectification

Users have the right to access the personal information concerning them held by Bluball, as well as the right to request correction where such information is inaccurate, incomplete, or ambiguous.

Information transmitted automatically

Certain information is automatically transmitted between the User’s device and Bluball’s systems when browsing the Platform. This information does not directly identify the User and is collected due to the technological requirements inherent to the use of the Internet. It is primarily used for analytical, service improvement, and statistical purposes.

When a User accesses the Platform, an automatic exchange of data occurs between their computer or mobile device and Bluball’s servers, as well as those of certain third-party providers. Such data does not, in itself, allow for the personal identification of the User.

The information that may be collected includes, in particular:

  • the User’s Internet domain name and IP address;
  • the type of browser and operating system used;
  • the pages visited and actions performed on the Platform;
  • the referring website address, where applicable;
